GEMA against OpenAI

13.11.2025

The Munich I Regional Court (Ref. 42 O 14139/24) has handed down its eagerly awaited ruling in the case of GEMA v. OpenAI Ireland Ltd./OpenAI LLC, which operates the AI program ChatGPT. GEMA filed a lawsuit because nine song lyrics—including well-known German songs such as “Atemlos” by Kristina Bach and “Männer” by Herbert Grönemeyer—were used by the ChatGPT system without a license and were played back largely true to the original in response to corresponding user queries.

A landmark ruling in the first instance, which is already generating anticipation for the next instance and then the Federal Court of Justice:

  • The Munich Regional Court assumed that training the language model with the song lyrics and, in particular, outputting these texts in identical or nearly identical wording constituted a reproduction relevant to copyright law.
  • The mere storage or “memorization” of the lyrics in ChatGPT was considered an infringement of the exploitation right pursuant to Section 16 of the German Copyright Act (UrhG). ChatGPT had not generated the song lyrics anew, but had resorted to the stored lyrics.
  • The limitation provision of Section 44b UrhG (“text & data mining”) was not applicable because not only had information been extracted, but complete works or word sequences had been taken over and stored in a reproducible form.
  • The output of the song lyrics – the AI output – constituted making available to the public within the meaning of Section 19a UrhG or reproduction.

AI is also boosting the media sector

There is hope in the media industry: the German government is planning a significant increase in film funding, partly financed by streaming providers through the planned Investment Commitment Act. This development is likely to see production-related law firms such as GreenbergTraurig, Brehm & v. Moers, Graef, and von Have Fey in particularly high demand.

Media: Contract and copyright law

The renowned media boutique is particularly sought after for TV and film productions and script reviews.

Other areas of focus: Copyrights, licenses, title protection, and funding law are part of everyday business. The same applies to operational issues faced by film and TV producers. Graef represents these clients, as well as other rights holders, in litigation under German and US law. Another focus is copyright advice for the publishing industry, where various traditional publishing houses have placed their trust in the team for many years. Regular press law review of content – both in print and moving images.

Developments: Similar to Brehm & v. Moers and Fieldfisher, this respected boutique firm is considered the trusted law firm of the production alliance. Following the departure of a team specializing in TT/data law and the games industry in the summer of 2024, Graef is primarily involved in providing operational advice to companies in the film and television industry and other cultural institutions. With the expansion of its team of associates, the firm is focusing on organic growth.

Frequently recommended: Dr. Ralph Graef (“committed and meticulous,” competitors)

Clients: Contract and copyright law: Docdays Productions on co-productions (including screenplay, financing, and worldwide distribution); Studio Rakete and Kosmo Films on co-productions; Network Movie on various productions, title protection and set consulting; Federal FDP on photo and video rights; Oxolo, The Smiley Company on licensing rights; Phidal Publishing on publishing rights; St. Pauli Theater on contract law; Ulysses Filmproduktion, among others, on animated film projects; Yari Film Group vs. Apollo Media and Collection Agent Fintage House; Crossover Konzeptgesellschaft on gallery and exhibition contracts; ongoing: a&o buero Filmproduktion, Brave New Work, Dropkick Pictures, Filmtest Hamburg, Hamburg Media School, New York Times, Nordmedia, Penguin Random House, The Astrid Lindgren Company, Tiger Media, TrueIllusion Film, Verlagsgruppe Oetinger.

Thomson Reuters and West Publishing win against AI company Ross Intelligence Inc.

21.02.2025

In a landmark ruling from the US the United States District Court for the District of Delaware held that the AI company Ross Intelligence is not allowed to use content from Thomson Reuter’s legal research platform Westlaw for the purpose of training its AI-based platform. Ross Intelligence’s fair use defense failed. The court argued that Ross Intelligence’s use of the data was commercial in nature and non-transformative because the use did not have a “further purpose or character” apart from Thompson Reuters’ use. Moreover, Ross Inteligence’ intended purpose was to compete with Thompson Reuters.

Very worth seeing, the documentary series “WTF is Jule?!” on ZDF, which we supervised in terms of film and press law.

23.01.2025

A serious and touching topic: on the trail of a catfish. A person who blogged under the fake identity Jule Stinkesocke as a supposedly paraplegic young woman. Jule Stinkesocke was a role model for many disabled people online, especially young disabled women. But instead, there are many indications that Jule is an older, non-disabled man. What a disappointment and a disaster for those affected.
Producing a movie like this over four episodes in a way that is unassailable under press law without taking away its “punch” and poignancy is an art form. We are pleased for all those affected, the producers and ZDF that we succeeded in doing this despite considerable headwinds in the run-up to the broadcast. 💪😊

WTF is Jule?!

Discussion by Dr. Ralph Oliver Graef on the OLG Cologne decision of 26.01.2024 (GRUR-RS 2024, 1143 – “Birkenstock”-Sandalen)

07.05.2024

The decision deals with the requirements of the concept of a work of applied art and the distinction from design law; the case in question involved “Birkenstock” sandals. The background to the current proceedings concerning “Birkenstock” sandals before the Higher Regional Court of Hamburg and the Higher Regional Court of Cologne, and their diametrically opposed decisions in the instances, show how important it is to establish a uniform concept of work under European law. In particular, if objects were purely functional in their product history, copyright protection must be correctly denied.

Discussion by Dr. Ralph Oliver Graef on the BGH decision GRUR-Prax 2023, 682 – The right to no longer be a victim).

01.12.2023

The background to this was a 2018 ZDF film about abducted children. This shed light on two abduction cases from the perspective of a journalist involved in the liberations. ZDF also reported on the abduction of the then eight-year-old plaintiff, which ended with her release after a ransom was paid, mentioning her birth name. To illustrate this, ZDF used two photos of the plaintiff, which her parents had made available to the investigating authorities for a public search. In addition, the cover page of a magazine was shown on which the plaintiff was pictured with her mother after her release. The Federal Court of Justice sets the duty of care of the press to obtain consent to use the images extremely high – even more than 30 years after the crimes. Too high, in the opinion of Dr. Ralph Oliver Graef.
